On TV, we see advertisements for spy toys and do it yourself kits that claim that you can investigate your neighbors, your cheating spouse, and your employees by yourself, without the need to hire a professional.

As technology advances, products are being introduced and sold on the internet that will allow you to spy on people in what seems to be almost too easy.  You can download key loggers that record every letter that your spouse might be typing, listen in on cell phones, track where a vehicle goes and more.  Used correctly, and where legal, these products have changed the way that investigations are being done. 

As an example, there are products that we discovered on the internet that can easily obtain information that you might believe will help you in your investigation. Used correctly, these are very useful products and investigators today are taking advantage of the technology that is being developed.   

BUT BEFORE YOU DO THIS ON YOUR OWN,
THERE ARE THINGS TO CONSIDER*

Will YOUR USE of any investigative tool, software, or scheme  to assist you in your case, or will that activity put you at risk?  That is a very serious question and one that you should ponder carefully before you attempt any "do it yourself" project as a home brewed investigator.  What you need is information that can be legally used in your case and the manner in which you obtain the information will sometimes become a question in your case.  You need a professional to assist you in the most important details of getting your case prepared.

We strongly recommend that you not attempt your own investigation, but instead locate a professional investigator to assist you in obtaining information that can be used to help you.

§ 2511. Interception and disclosure of wire, oral, or electronic communications prohibited

(1) Except as otherwise specifically provided in this chapter any person who—

(a) intentionally intercepts, endeavors to intercept, or procures any other person to intercept or endeavor to intercept, any wire, oral, or electronic communication;

(b) intentionally uses, endeavors to use, or procures any other person to use or endeavor to use any electronic, mechanical, or other device to intercept any oral communication when—

(i) such device is affixed to, or otherwise transmits a signal through, a wire, cable, or other like connection used in wire communication; or

(ii) such device transmits communications by radio, or interferes with the transmission of such communication; or

(iii) such person knows, or has reason to know, that such device or any component thereof has been sent through the mail or transported in interstate or foreign commerce; or

(iv) such use or endeavor to use (A) takes place on the premises of any business or other commercial establishment the operations of which affect interstate or foreign commerce; or (B) obtains or is for the purpose of obtaining information relating to the operations of any business or other commercial establishment the operations of which affect interstate or foreign commerce; ......

.....shall be punished as provided in subsection (4) or shall be subject to suit as provided in subsection (5).

 

Basically, what we're pointing out to you is that you should seek the counsel of an attorney prior to acting on your own to conduct any investigation where by you may or may not be violating the rights of the subject of your investigation and more so, exposing yourself to criminal conduct.
